Guest Conduct Policy

“Margaritaville at Sea®” as used in this Policy shall mean and include the Vessel, and all its owners, operators, employees, agents, and charterers.

“Guest” shall include the plural where appropriate and means all persons or entities booking or purchasing passage and/or traveling under the Cruise Ticket Contract, including heirs, representatives, and any accompanying minors. The masculine includes the feminine. “Guest” shall have the same meaning as “Passenger.”

“Cruise Party,” for purposes of this Policy, shall be given its broadest possible interpretation and shall include, but not be limited to: (1) persons traveling in the same stateroom or reservation, (2) persons traveling in multiple staterooms or as part of multiple reservations, as well as (3) persons we determine to be legally or socially related or proximate in any way, at any time prior to or during the voyage, for any duration of time.

In certain rare cases, Margaritaville at Sea® must unfortunately enforce this Policy. IF MARGARITAVILLE AT SEA® EXERCISES THE AFOREMENTIONED RIGHT TO ENFORCE THIS POLICY, GUEST AND/OR CRUISE PARTY AGREE THAT HE/SHE/THEY SHALL HAVE NO CLAIM(S) AGAINST MARGARITAVILLE AT SEA® WHATSOEVER AND MARGARITAVILLE AT SEA® SHALL HAVE NO LIABILITY FOR REFUND, COMPENSATION, LOSS OR DAMAGES OF GUEST AND/OR CRUISE PARTY OF ANY KIND WHATSOEVER FOR THE GUEST’S AND/OR CRUISE PARTY’S BOOKING OR CRUISE OR ANY ACCOMMODATIONS OR TRAVEL ARRANGEMENTS PRE- OR POST-CRUISE, INCLUDING BUT NOT LIMITED TO ANY EXPENSES INCURRED BY GUEST AND/OR CRUISE PARTY FOR ACCOMMODATIONS OR REPATRIATION.

THIS POLICY SHALLY APPLY ONBOARD OUR VESSELS AND ASHORE IN AND AROUND OUR TERMINALS AND PORTS OF CALL.

IT IS A CONDITION OF BOARDING AND REMAINING ONBOARD ANY OF OUR SHIPS THAT ALL GUESTS AND CRUISE PARTIES COMPLY WITH THIS POLICY AND ALL OF OUR HEALTH AND SAFETY POLICIES AND PROCEDURES.  IN ADDITION, GUESTS AND CRUISE PARTIES ARE REQUIRED TO COMPLY WITH ALL APPLICABLE LAWS OF THE VARIOUS COUNTRIES THAT THEY VISIT.

FAILURE TO COMPLY WITH THIS POLICY, ANY OF OUR OTHER POLICIES, OR ANY INSTRUCTION COMMUNICATED BY US (INCLUDING OUR CREW) AT ANY TIME IN ANY FORM, WRITTEN OR ORAL, WILL BE CONSIDERED A BREACH OF THIS POLICY AND MAY RESULT IN ONE OR MORE ENFORCEMENT ACTIONS AS DESCRIBED BELOW, INCLUDING DENIAL OF BOARDING, OR REMOVAL FROM THE SHIP WITHOUT ANY COMPENSATION OR REFUND. IN CERTAIN CIRCUMSTANCES OUR ENFORCEMENT ACTION(S) MAY RESULT NOT ONLY IN REMOVAL OF THE GUEST AND/OR CRUISE PARTY, BUT THE REMOVAL OF ALL OTHER PERSONS IN THE GUEST’S CRUISE PARTY OR RESERVATION(S).

THIS POLICY IS SUBJECT TO THE CAPTAIN’S OVERRIDING AUTHORITY UNDER NATIONAL OR INTERNATIONAL LAW TO MAKE AND EXECUTE DECISIONS WHICH, IN THE CAPTAIN’S SOLE PROFESSIONAL JUDGEMENT, ARE NECESSARY TO MAINTAIN THE HEALTH, SAFETY AND SECURITY OF THE SHIP.

A GUEST’S ACTUAL OR THREATENED VIOLATION OF THIS POLICY, ANY OF OUR OTHER POLICIES, OR ANY INSTRUCTION COMMUNICATED BY US (INCLUDING OUR CREW) AT ANY TIME IN ANY FORM, WRITTEN OR ORAL, OR OUR ASSESSMENT IN OUR SOLE DISCRETION THAT A GUEST’S OR CRUISE PARTY’S PRESENCE ONBOARD CREATES A CONCERN OR RISK FOR THE HEALTH, SAFETY, OR SECURITY OF OTHER GUESTS, OUR CREW OR THE VESSEL MAY RESULT IN ONE OR MORE OF THE FOLLOWING ENFORCEMENT ACTIONS:

• Intervention by Security, other management personnel, or law enforcement;
• Reporting to the competent government and law enforcement authorities;
• Removal of certain onboard privileges, which may include being detained, quarantined or confined in a stateroom or holding cell at the expense of the Guest and/or Cruise Party and Margaritaville at Sea® reserves the right to retain your credit card and/or debit card details as presented at registration and charge the credit /debit card in such amounts as it shall in its sole discretion deem necessary for the cost of such detention;
• Confiscation of illegal, contraband or prohibited items, which may, at our discretion, be turned over to law enforcement authorities;
• Legal action;
• Denial of boarding or removal from the vessel;
• Denial of boarding on any future Margaritaville at Sea® cruise vacation; and/or
• Imposition of a fine up $500 for any physical altercations or assault on any Guest, Cruise Party member, employee or crew member on any Margaritaville at Sea® cruise vacation, whether same occurs in or near the premises of the cruise terminal or on the Vessel.

ANY OF OUR DETERMINATION(S), ASSESSMENT(S), JUDGMENT(S), DECISION(S), OR ENFORCEMENT ACTION(S) UNDERTAKEN BY US PURSUANT TO THIS POLICY SHALL BE IN OUR SOLE DISCRETION AND SHALL BE FINAL.

Guests and Cruise Parties must follow all instructions provided by our onboard security personnel at the terminal, onboard, ports of call and shore excursions. Refusal to follow all instructions provided by our security personnel may result in the enforcement actions set forth in Section 2.2 above, which may include denial of boarding or removal from the vessel.

Guests and Cruise Parties will undergo a security screening prior to boarding the vessel at the beginning of the cruise and at ports of call, and at any time where we may, in our sole discretion, require such security screening during the voyage. We also require a security photo for each Guest and Cruise Party member. While taking the security photo and during a security screening, we may require Guests to briefly remove any facial coverings (e.g., masks), hats, costumes, or other materials that may impede the verification of a Guest’s identity. A Guest’s refusal to participate in the security screening or provide a security photo may result in denial of boarding or removal from the vessel.

Guests and Cruise Parties shall attend the mandatory safety drill (the “Muster”) and follow all health and safety instructions issued by the Captain. Upon embarkation, Guests and Cruise Parties must (a) review essential safety information and (b) report to their designated Muster station. Guests and Cruise Parties will be required to participate in a brief safety presentation upon arrival at their designated Muster station.

Guests and Cruise Parties must immediately report illness, injuries, unsafe or illegal behavior to the ship’s security personnel or other ship management. Guests and Cruise Parties can do so by calling or visiting the Guest Relations Desk, or by contacting the ship’s security personnel or other ship management wherever they are available.

A Guest’s or Cruise Party’s failure to immediately report an illness, injury, unsafe or illegal behavior may impede the ship personnel’s ability to effectively respond. Any delay may also impede the ship’s ability to properly preserve information or evidence and may cause a delay in notifying the proper law enforcement or other government officials.

We reserve the right to take action against any Guest or Cruise Party found to have tampered and/or interfered with any fire detection equipment on the Vessel, including but not limited to smoke detectors in public areas and bedrooms, break glass points, exit signs, fire safety doors, fire alarms, and fire extinguishers. Guests and/or Cruise Parties found to have tampered with any fire detection or firefighting equipment will be charged with any costs incurred by Margaritaville at Sea® due to their actions, including a penalty fine up to $250 per Guest and may be required to disembark the Vessel at our sole discretion. Depending on the severity of Guest’s and/or Cruise Party’s actions, we may involve law enforcement at our sole discretion. If we discover that firefighting or detection equipment has been tampered with after a Guest or Cruise Party has disembarked, we reserve the right to, and Guest or Cruise Party authorizes us to, charge his/her/their credit/debit card on file for any amount we incur to fix and/or replace the equipment and to charge a penalty fine up to $250 per guest.

We have policies and procedures in place consistent with current government, regulatory and public health guidance to ensure that we are providing a safe and healthy environment to all guests.

GUESTS AGREE TO REVIEW AND COMPLY WITH ALL OF OUR HEALTH AND SAFETY INSTRUCTIONS, OR OTHER POSTED SIGNAGE. FAILURE TO DO SO MAY LEAD TO DISCIPLINARY ACTION(S), WHICH MAY INCLUDE BEING DENIED BOARDING OR REMOVAL FROM THE VESSEL, AS WELL AS THE DENIAL OF BOARDING OR REMOVAL OF A GUEST’S CRUISE PARTY, FROM THE VESSEL.

We will update our policies and procedures as public health guidance evolves. The relevant policies and procedures are available on Margaritaville at Sea’s® website at https://margaritavilleatsea.com/prepare-to-sail/.

WE RESERVE THE RIGHT TO DENY BOARDING TO ANY GUEST EXHIBITING SYMPTOMS OF COMMUNICABLE DISEASE(S), INCLUDING COVID-19, OR WHOSE HEALTH SCREENING RESULTS SHOW THEY MAY HAVE CONTRACTED SUCH A DISEASE(S). BOARDING MAY ALSO BE DENIED TO GUESTS WE DEEM, IN OUR SOLE DISCRETION, TO BE A CLOSE CONTACT OR IN THE CRUISE PARTY OF ANY GUEST EXHIBITING SYMPTOMS OF A COMMUNICABLE DISEASE, INCLUDING SOME OR ALL OF THAT GUEST’S CRUISE PARTY.

You may view our Privacy Policy for information on how we securely collect, retain, store and share, as may be applicable, Guest health information.

We will conduct mandatory health screenings prior to boarding. Health and safety procedures will be in place during the boarding process. Guests shall comply with all procedures, signs and instructions prior to embarking the vessel.

During the pre-boarding health testing and screening process, Guests must provide accurate information at all times. Guests shall cooperate with us, our agents, or service providers, during any attempt to obtain health information and/or carry out any health-related function.

GUESTS WHO REFUSE TO PROVIDE HEALTH INFORMATION OR WHO WILLFULLY PROVIDE INACCURATE HEALTH INFORMATION TO OUR MEDICAL TEAM AS PART OF A HEALTH SCREENING OR HEALTH ASSESSMENT MAY BE DENIED BOARDING, QUARANTINED OR SUBJECT TO OTHER DISCIPLINARY ACTION(S).

Further details about this process will be provided to Guests prior to their voyage.

GUESTS EXPERIENCING ANY SYMPTOMS OF ANY COMMUNICABLE DISEASE, HOWEVER MILD, INCLUDING SYMPTOMS OF COVID-19, DIARRHEA, OR VOMITING, MUST IMMEDIATELY RETURN TO THEIR STATEROOM AND REPORT THE ILLNESS TO THE SHIP’S MEDICAL PERSONNEL BY CALLING THE ONBOARD MEDICAL FACILITY.

GUESTS ARE ALSO REQUIRED TO IMMEDIATELY REPORT SYMPTOMS OF ANY COMMUNICABLE DISEASE FOR MEMBERS OF THE GUEST’S CRUISE PARTY OR ENSURE THOSE PERSONS EXPERIENCING SYMPTOMS IMMEDIATELY RETURN TO THEIR RESPECTIVE STATEROOM(S) AND REPORT TO THE SHIP’S MEDICAL PERSONNEL BY CALLING THE ONBOARD MEDICAL FACILITY.

FAILURE TO IMMEDIATELY REPORT A COMMUNICABLE DISEASE OR ITS SYMPTOMS, OR WILLFULLY FAILING TO ACCURATELY REPORT SYMPTOMS IS A VIOLATION OF THIS POLICY AND GUESTS MAY BE SUBJECT TO DISCIPLINARY ACTION, INCLUDING BUT NOT LIMITED TO DEBARKATION.

COVID-19 symptoms include but are not limited to: (1) high temperature or fever, (2) coughing, (3) shortness of breath or difficulty breathing, (4) a loss or change in sense of taste or smell, (5) muscle aches, (6) headaches and (7) fatigue.

Guests will be in violation of this Policy if they fail to comply with all treatment instructions issued by the ship’s crew and/or medical personnel.

Guest, or others in the Guest’s Cruise Party, may be confined to his/her stateroom or placed in quarantine to avoid a communicable disease or other contagious condition from spreading to other guests. We may require guests to move to a new stateroom that has been set up specifically for isolation/quarantine.

Guests must comply with all instructions given by crew during the period of isolation/quarantine and fully cooperate with crew throughout the disembarkation procedure.

Guests must wash their hands with soap and hot water after using the restroom and before eating or handling food. Hand washing thoroughly for at least 20 seconds with soap and hot water after using the restroom and before eating or handling food can help prevent contagious illnesses from starting and/or spreading.

GUESTS AGREE TO REVIEW AND COMPLY WITH ALL OF THE BELOW GUEST CONDUCT REQUIREMENTS AND INSTRUCTIONS. FAILURE TO DO SO MAY LEAD TO DISCIPLINARY ACTION(S), WHICH MAY INCLUDE BEING DENIED BOARDING OR REMOVAL FROM THE VESSEL, AS WELL AS THE DENIAL OF BOARDING OR REMOVAL OF A GUEST’S CRUISE PARTY FROM THE VESSEL.

If a Guest is required to take any action by a government entity, government official or government regulations and laws and Guest does not follow such directives, instructions and/or regulations, he/she will be in violation of this Policy.

If a Guest refuses to permit search of his or her person or property, then he/she will be in violation of this Policy.

If a Guest refuses to produce identification on request, then he/she will be in violation of this Policy.

If a Guest is traveling across any international boundary and: (1) the travel documents of such Guest and those in his/her Cruise Party are not in order; or (2) such transportation would be unlawful, then he/she will be in violation of this Policy.

When a Guest fails and/or refuses to comply with: (1) any directive from the Master; (2) any of the Margaritaville at Sea® rules or regulations and/or this Policy; or (3) any term of the applicable Cruise Ticket Contract, then he/she will be in violation of this Policy.

It is Margaritaville at Sea’s® policy that our Guests and crew have the right to be treated with dignity and respect. Margaritaville at Sea® may refuse to accept a booking request from a Guest, refuse to allow a Guest to board a vessel or remove any Guest from its vessel or port facilities, when such refusal to book or removal of the Guest is reasonably necessary in Margaritaville at Sea’s® sole discretion for the Guest’s safety, for the comfort or safety of other Guests or Margaritaville at Sea® employees and crew, or for the prevention of damage to the property of Margaritaville at Sea® and/or its Guests, employees or crew. Margaritaville at Sea® reserves the right to retain your credit card and/or debit card details as presented at registration and Guest and/or Cruise Party agrees and authorizes his/her/their credit /debit cards to be charged in such amounts as  Margaritaville at Sea® shall, in its sole discretion, deem necessary to compensate or make good the cost or expenses incurred for any detention or removal of a Guest and/or Cruise Party, or send an invoice to Guest’s registered address for any amount we incur for detainment or removal. Depending on the severity of the Guest’s actions, law enforcement may become involved at our sole discretion. By way of example, and without limitation, Margaritaville at Sea® may refuse to book/transport or may remove Guest from its port terminal and/or vessel in any of the following situations:

• When Guest’s conduct is disorderly, physically and/or verbally abusive or violent. When Guest’s language is verbally abusive or offensive and directed toward anyone, including other Guests, crew members, port terminal employees, governmental officials, or others. When Guest’s conduct is inappropriate or abusive, including uninvited physical contact, solicitation, harassment, vandalism, theft, violence, use of fake/false identification, underage drinking, providing alcohol to underage guests, possession of illegal substances/items or any other illegal or offensive conduct.
• When Guest attempts self-harm or makes any oral or written statements or engages in conduct that would evidence an intent to engage in self-harming behavior.
• When Guest attempts to interfere with any employee at the port terminal or on the vessel in the pursuit of his or her duties or fails to obey the instruction of any employee.
• When Guest has a contagious disease that may be transmissible to other guests during the cruise.
• When Guest’s behavior may be hazardous to himself/herself, shoreside employees, crew or other guests.
• When Guest is seriously ill and would present a danger to other guests.
• When Guest’s conduct creates an unreasonable risk of abuse, offense or annoyance to other guests, shoreside employees or crew.
• When Guest’s conduct creates a risk of harm or damage to the vessel and/or property, or the property of other guests, employees and/or crew.
• When Guest attempts to sell or advertise products or services onboard or attempts to or engages in demonstrations, protests or other behavior onboard which, in Margaritaville at Sea’s® sole discretion, is detrimental to the onboard atmosphere, the enjoyment of the cruise by other guests or is contrary to the rights or expectations of concessionaires or vendors onboard or Margaritaville at Sea®.
• Any Guest who on a previous cruise with Margaritaville at Sea®, or its parent, subsidiaries or affiliates, committed a violation of this Policy that resulted in the early removal of the Guest, the denial of boarding for the Guest, or other disciplinary measures.
• When Guest attempts to sit, stand, lay or climb on, over or across any exterior or interior railings or other protective barriers, or tampers with ship’s equipment, facilities or systems designed. Guests may not enter or access any area that is restricted and/or for the use of crew members. Any other unsafe behavior, including failure to follow security instructions, is not permitted.
• Pool, deck and theater chairs may not be reserved. Topless sunbathing is not permitted. Boom boxes, speakers, or loud radios are not permitted. Roller blades, roller skates, skateboards, scooters, surfboards, bicycles, drones, and similar items may not be utilized on-board; except for mobility aids related to special needs, as approved by Margaritaville at Sea®.

Guests who violate any alcohol policy, including but not limited to underage drinking, providing alcohol to minors or young adults, engaging in alcohol drinking games, or failing to consume alcohol responsibly, will be considered for discipline under the provisions of this Policy and may be also debarked at any port at any time or not allowed to board, according to this Policy. In such cases, no voyage and/or repatriation costs, airfare or any other expenses will be reimbursed. Margaritaville at Sea® reserves the right to revoke or otherwise restrict drinking privileges of any Guest, regardless of age. The ship’s staff may refuse to serve alcoholic beverages to any Guest who does not consume alcohol responsibly and may request verification of Guest’s age to determine whether he/she is of age to consume alcohol pursuant to this Policy. The minimum drinking age for all alcoholic beverages on Margaritaville at Sea’s® vessel is 21. Guests who are 18-20 years of age can purchase and responsibly consume alcoholic beverages when the ship is in international waters (3 miles out of US territorial waters). If any Guest violates this Policy, we reserve the right to impose a fine on each Guest and/or Cruise Party member up to $250, and Guest and/or Cruise Party hereby authorizes Margaritaville at Sea® to charge Guest’s and/or Cruise Party’s credit or debit card on file, and/or Margaritaville at Sea® may take any other appropriate legal action depending on the severity of the consequences of the infraction of this Policy.

Margaritaville at Sea® only allows smoking in the designated smoking area located on the port side of Deck 11 of the Vessel. For our safety purposes and for our Guests’ comfort and health, all other areas of the ship are non-smoking, including public rooms, restaurants, staterooms and suites, verandas and halls. Please note that this Policy includes products such as electronic cigarettes. If any Guest violates this smoking policy, we reserve the right to impose a vessel safety fine on each Guest and/or Cruise Party member up to $250, and Guest and/or Cruise Party hereby authorizes Margaritaville at Sea® to charge Guest’s and/or Cruise Party’s credit or debit card on file, and/or Margaritaville at Sea® may take any other appropriate legal action depending on the severity of the consequences of the infraction of this Policy. We also reserve the right to charge the Guest for any additional cleaning costs or loss of revenue caused by smoking in non-smoking areas of the Vessel.

A minor is defined as anyone under the age of 18. A young adult is defined as anyone between the ages of 18-20. Parents and guardians are responsible for the behavior and appropriate supervision of their accompanying minor(s) and young adult(s) throughout their cruise. This obligation applies inside terminals, while onboard, at our ports of call, and during shore excursions. This responsibility applies at all times, regardless of whether the parents and guardians are physically in the company of their minor(s) and young adult(s). Under no circumstances should the parent or guardian of a minor debark the ship without their accompanying minor(s) or without having made arrangements for the accompanying minor(s) appropriate supervision on the ship during their absence.

Crew members are prohibited from engaging in physical relationships with Guests. Crew members are not permitted to socialize with Guests beyond their professional duties, and are not permitted to be in Guest staterooms, except for the performance of their shipboard duties. Guest agrees to respect these policies and is similarly prohibited from engaging in physical relationship with crew members. Guest is not permitted in any restricted or crew area of the ship, including crew staterooms and corridors.

Guest will be subject to disciplinary action pursuant to this Policy if he/she is found to have brought onboard any Margaritaville at Sea® Vessel any of the following prohibited items, including:

• Any item that generates heat or produces an open flame are not permitted onboard including, but not limited to, clothing irons, hotplates, candles, incense, and any other item that may create a fire hazard;
• No illegal drugs or other illegal substances are permitted onboard, including but not limited to medical marijuana except for Guests with special needs, as approved by Margaritaville at Sea® prior to the cruise, and may not be used during any point during a Margaritaville at Sea® voyage, including inside terminals, during shore excursions, or on the vessel itself. Illegal drugs or substances will be confiscated and appropriate action taken, which may include removal from the vessel and involvement of appropriate legal authorities. Guests may be subject to arrest and prosecution by foreign jurisdictions and may be prevented from re-boarding the ship;
• No weapon, explosive, or other item that presents a risk of harm to individuals or property are permitted on board any Margaritaville at Sea® vessel. Any such item will be confiscated by Margaritaville at Sea® security personnel and appropriate action taken.
• Non-alcoholic drinks, including but not limited to water, soda, and juices are not permitted to be brought onboard either as a carry-on or checked luggage on both embarkation and port days. There may be exceptions for guests with special needs, as approved by Margaritaville at Sea® prior to the cruise.

We reserve the right to charge, and Guest and/or Cruise Party hereby authorizes Margaritaville at Sea® to charge, Guest’s and/or Cruise Party’s credit or debit card in such amounts as Margaritaville at Sea® shall in its sole discretion deem necessary for the cost of replacing any items that Guest and/or the Cruise Party removes from the premises of the Cruise Terminal or the vessel without Margaritaville at Sea’s® written consent or without a receipt for purchase of same. The charge will be the full replacement amount of the missing item, including any shipping charges. If we discover any item missing after the Guest and/or Cruise Party has disembarked the Vessel, we reserve the right to charge, and Guest and/or Cruise Party hereby authorizes Margaritaville at Sea® to charge, Guest’s and/or Cruise Party’s credit or debit card in such amounts as Margaritaville at Sea® shall in its sole discretion deem necessary.

Guest and Cruise Party are liable for any damage caused whatsoever of any kind to Margaritaville at Sea’s® property, including the Vessel, ports of call, and/or the Cruise Terminal premises.  Margaritaville at Sea®  reserves the right to charge Guest and/or the Cruise Party the cost of rectifying such damage by retaining Guest’s and/or Cruise Party’s credit card and/or debit card details as presented at registration and Guest and/or Cruise Party hereby authorizes Margaritaville at Sea®  to charge Guest’s and/or Cruise Party’s credit or debit card in such amounts as it shall in its sole discretion deem necessary to compensate or make good the cost or expenses incurred or suffered by Margaritaville at Sea® as a result of the damage. Should this damage be discovered after the Guest or Cruise Party has disembarked, we also reserve the right and Guest and/or Cruise Party hereby authorizes Margaritaville at Sea® to charge Guest’s and/or Cruise Party’s credit or debit card for any damage incurred to your cabin, the vessel, port of call, and/or the cruise terminal, including and without limitation for all property damage, missing or damaged items, smoking fees, cleaning fees, guest compensation, etc. In the alternative, Margaritaville at Sea® may issue Guest or any member of the Cruise Party an invoice for such damages. We will make every effort to rectify any damage internally prior to contracting any specialists to make the repairs and will make every effort to keep any costs that the Guest would incur to a minimum. In severe cases, Guest will be liable for any loss of revenue that Margaritaville at Sea® suffers while the Guest’s or Cruise Party’s room is being repaired and/or restored so that it can be used for other guests again.

Guest and Cruise Party agree to be held personally liable in the event that any Guest and/or Cruise Party member, group, company or association fails to pay all, or any part, of any charges incurred before, during, or after their passage.

ADDITIONALLY, GUEST AND/OR CRUISE PARTY SHALL BE LIABLE TO INDEMNIFY AND HOLD MARGARITAVILLE AT SEA®, INCLUDING THE VESSEL, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND CHARTERERS, HARMLESS FROM AND AGAINST ALL DAMAGES OR LOSSES WHATSOEVER THAT GUEST AND/OR CRUISE PARTY CAUSED TO ANOTHER GUEST’S OR CREW MEMBER’S PERSONAL SAFETY OR PROPERTY, BY ANY ACT OR OMISSION OF THE GUEST OR THOSE FOR WHOM THE GUEST IS RESPONSIBLE AND/OR MEMBER OF THE CRUISE PARTY. GUEST AND/OR CRUISE PARTY FURTHER AGREE TO PAY ANY DEFENSE COSTS OF MARGARITAVILLE AT SEA®, INCLUDING THE VESSEL, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND CHARTERERS, FOR COUNSEL OF ITS/THEIR CHOICE TO DEFEND ANY ACTION, DEMAND, CLAIM, OR LAWSUIT ARISING FROM, RELATED TO, OR IN CONNECTION WITH ALL DAMAGES OR LOSSES GUEST AND/OR CRUISE PARTY CAUSED TO ANOTHER GUEST’S OR CREW MEMBER’S PERSONAL SAFETY OR PROPERTY, BY ANY ACT OR OMISSION OF THE GUEST OR THOSE FOR WHOM THE GUEST IS RESPONSIBLE AND/OR THE CRUISE PARTY.

This Policy shall remain in full force and effect until Margaritaville at Sea® chooses, in its sole discretion, to update or modify all or part of this Policy. Updates or modifications to this Policy may be made and shall be effective without publication, although we will endeavor to post any updates or modifications to this Policy in a timely manner and to a publicly accessible forum, including but not limited to the Margaritaville at Sea® website.
