Welcome to the Margaritaville at Sea Casino Rewards Program (the “Program”). The Program is operated by Margaritaville at Sea (the “Company,” “Margaritaville at Sea,” “MVAS,” “we,” “our,” or “us”).
Please read these Terms and Conditions (“Terms”) carefully before enrolling in or participating in the Program. By enrolling in, accessing, or participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms, as amended from time to time.
The Company has sole discretion in administering the Program and interpreting these Terms, including determining eligibility, account status, point balances, Tier Status, benefits, Rewards, offers, and other matters relating to the Program, subject to applicable law.
The Program is a promotional loyalty program. Membership in the Program does not create any contractual right to continued participation, benefits, offers, Rewards, Tier Status, or any particular Program feature.
1. Eligibility
To participate in the Program, you must:
- - Be at least eighteen (18) years of age;
- - Be legally permitted to gamble where the applicable gaming activity occurs;
- - Present valid government-issued photo identification upon request; and
- - Meet any other eligibility requirements established by the Company.
Individuals who are self-excluded, excluded, suspended, trespassed, casino banned, prohibited from gaming, listed on an applicable Company exclusion or Prevent Departure List, or otherwise restricted from participation by the Company or applicable law are not eligible to participate in casino gaming or earn Program benefits during the applicable restriction period.
Corporations, organizations, groups, partnerships, trusts, and other entities may not enroll as Program members.
Membership, accounts, Reward Points, Tier Points, Tier Status, Rewards, benefits, and offers are personal to the individual member and may not be transferred, assigned, sold, purchased, bartered, combined, or shared except where expressly authorized by the Company.
Employees of the Company and other individuals designated by Company policy may be restricted or prohibited from participating in the Program or casino gaming. Employee participation will be governed by applicable Company policies.
2. Enrollment and Membership Accounts
Eligible individuals may enroll at participating Margaritaville at Sea casino locations at the Casino Host desk or through any other enrollment method made available by the Company.
The Company will establish a membership account in the member’s name and assign a unique membership number or other account identifier.
Members may be required to present valid identification to enroll, access their account, obtain or replace a Rewards Card, redeem certain Rewards, receive benefits, or complete other Program transactions.
Each person may maintain only one Program account.
If the Company determines that a member has multiple accounts, the Company may combine the accounts, transfer eligible activity into one account, close duplicate accounts, reverse duplicate credits, or take any other corrective action it determines appropriate.
Members are responsible for providing accurate information and keeping their account information current.
3. Rewards Card and Account Use
Members will receive a physical casino loyalty card, room key functionality, or other method designated by the Company for tracking qualifying casino play (“Rewards Card”).
A member’s Rewards Card and Program account may only be used by that member.
Members may not allow another person to use their Rewards Card, account, membership number, room key, or other Program credential to record gaming activity or receive Program benefits.
Members are responsible for ensuring that their Program account is properly associated with their casino play.
For slot-machine or other eligible electronic gaming activity, members must properly insert to activate their Rewards Card or account with the gaming device.
For table-game activity, members must present their Rewards Card or account information to casino personnel and ensure their play is properly recorded.
The Company is not responsible for casino play that is not properly recorded because a member failed to use their Rewards Card, failed to identify themselves to casino personnel, removed their card before completion of play, or otherwise failed to properly associate their Program account with qualifying gaming activity.
4. Reward Points
Members may earn redeemable Program points (“Reward Points”) through qualifying rated casino play and through other eligible activities or promotions designated by the Company.
The methods, formulas, rates, games, activities, and requirements used to earn Reward Points may vary and may be changed by the Company from time to time.
Current earning and redemption information may be provided through Program materials, promotional communications, Frequently Asked Questions, onboard signage, the Company’s website, casino personnel, or other channels designated by the Company.
Only properly recorded and verified activity is eligible to earn Reward Points.
Reward Points are promotional in nature, have no cash value unless expressly stated otherwise, do not constitute property of the member, and may not be transferred, purchased, sold, assigned, inherited, bartered, or exchanged for cash.
Reward Points may only be redeemed in accordance with the Program rules in effect at the time of redemption.
5. Tier Points and Tier Qualification
The Company may separately award qualifying points used to determine Program Tier Status (“Tier Points”).
Tier Points and Reward Points are separate Program measurements and may be earned or calculated differently.
Unless otherwise expressly stated by the Company, promotional, bonus, manually adjusted, complimentary, transferred, or other non-qualifying points do not count toward Tier Status.
The annual Tier Earning Period runs from October 1 through September 30.
Tier Points reset to zero at the beginning of each new Tier Earning Period.
Tier Points earned during the applicable Tier Earning Period determine a member’s Tier Status in accordance with the qualification requirements established by the Company.
Members may advance to a higher Tier during the Tier Earning Period once the applicable qualification threshold has been reached and verified by the Company.
The Company reserves the right to establish, modify, eliminate, or replace Tier levels, qualification thresholds, Tier Point earning formulas, qualification periods, and other Tier requirements.
The Company’s casino-management systems and official records will control in determining Tier Points and Tier Status.
6. Rated Table-Game Play
Table-game ratings may be based on factors determined by the Company, including, without limitation:
- - Type of game played;
- - Average wager;
- - Length of play;
- - Other factors used by the Company’s casino-management or player-rating systems.
Table-game ratings are estimates of gaming activity and may not reflect every individual wager placed by a member.
The Company’s recorded rating and casino-management system records will be considered the official record of the member’s rated table-game activity.
7. Tier Status and Tier Benefits
Tier benefits may include amenities, services, recognition, discounts, complimentary items, promotional opportunities, gaming benefits, travel benefits, or other benefits designated by the Company.
Tier benefits may vary by Tier level, ship, sailing, itinerary, venue, operating schedule, availability, or other circumstances.
Members who qualify for a higher Tier during a cruise may have their Tier Status updated during the sailing; however, certain benefits associated with the new Tier may begin on the member’s next sailing or at another time determined by the Company.
Tier Status does not guarantee availability of any particular benefit.
All Tier benefits are subject to availability, capacity, operational limitations, applicable venue hours, sailing schedules, vessel capabilities, inventory, applicable rules, and other restrictions.
The Company may substitute a benefit with another benefit that it determines is reasonably comparable.
Tier Status and Tier benefits have no cash value and may not be transferred, sold, exchanged, or assigned.
8. Redemption of Reward Points
Reward Points may be redeemed only for eligible Rewards offered by the Company and only while the member’s account is active and in good standing.
Available Rewards, redemption values, redemption thresholds, participating locations, and applicable restrictions may change at any time.
Rewards may be subject to availability and may be discontinued, substituted, restricted, or modified by the Company.
Reward Points may not be redeemed for cash unless expressly authorized by the Company.
The Company may require identification, account verification, or additional information before permitting redemption.
Once Reward Points have been redeemed, the transaction may be final unless otherwise determined by the Company.
9. Promotional Offers
From time to time, members may receive promotional offers based on Tier Status, gaming activity, theoretical gaming value, actual casino win/loss, travel history, geographic market, promotional criteria, or other factors determined by the Company.
Receipt of an offer by one member does not guarantee that another member will receive the same or a similar offer.
Promotional offers may be personalized and are non-transferable unless expressly stated otherwise.
Offers may include additional terms, eligibility requirements, booking requirements, qualifying gaming requirements, expiration dates, blackout dates, capacity controls, cabin restrictions, Free Slot Play, table-game promotional play, complimentary amenities, discounts, drawings, events, or other conditions.
Unless expressly stated otherwise, promotional offers may not be combined.
In the event of a conflict between these Terms and the specific terms applicable to a promotional offer, the terms of the specific promotional offer will control with respect to that offer.
The Company reserves the right to correct, cancel, rescind, or modify an offer issued as a result of an error, system malfunction, incorrect data, unauthorized activity, or other mistake.
10. Point Expiration
Reward Points expire ninety (90) days after the date on which they are earned unless otherwise expressly stated by the Company.
Unless specifically provided otherwise by the Company, subsequent account activity does not extend the expiration date of previously earned Reward Points.
Expired Reward Points will be automatically removed from the member’s account and will not be reinstated except at the Company’s sole discretion.
Tier Points are governed by the applicable Tier Earning Period and are not subject to the Reward Point expiration rules.
11. Lost, Stolen, or Misused Rewards Cards
Members should promptly report a lost, stolen, or compromised Rewards Card or Program account to casino personnel.
The Company may require identification before issuing a replacement card or providing account access.
The Company is not responsible for unauthorized use of a member’s Rewards Card or Program account occurring before the loss, theft, or compromise is reported to the Company, except as otherwise required by applicable law.
12. Account Adjustments, Errors, and Misuse
The Company may review, investigate, adjust, reverse, remove, withhold, or correct Reward Points, Tier Points, Tier Status, Rewards, promotional offers, complimentary benefits, gaming ratings, or other account activity if the Company determines that the activity resulted from or involved:
- - Fraud or suspected fraud;
- - Theft or attempted theft;
- - Rewards Card or account sharing;
- - Duplicate accounts;
- - Improperly recorded casino play;
- - Incorrect ratings;
- - System, equipment, or software malfunction;
- - Clerical or operator error;
- - Unauthorized account access;
- - Manipulation or attempted manipulation of the Program;
- - Abuse or misuse of an offer, Reward, benefit, or promotion;
- - Violation of casino rules;
- - Violation of these Terms;
- - Activity inconsistent with applicable law or Company policy; or
- - Any other error or irregularity identified by the Company.
The Company may temporarily suspend an account while reviewing suspected improper activity.
Program activity reflected in a member’s account is subject to verification and correction.
The Company’s books, records, casino-management systems, player-tracking systems, and transaction records will constitute the official record for purposes of administering the Program.
13. Suspension or Termination of Membership
The Company may suspend, restrict, or terminate a member’s Program account or participation in the Program for any lawful reason, including, without limitation:
- - Violation of these Terms;
- - Fraudulent or abusive activity;
- - Misuse of a Rewards Card;
- - Threatening, disruptive, abusive, or inappropriate conduct;
- - Violation of casino, ship, or Company rules;
- - Self-exclusion or involuntary exclusion;
- - Failure to satisfy eligibility requirements;
- - Suspicious or unlawful activity; or
- - Conduct the Company determines is inconsistent with the integrity or intended operation of the Program.
Upon termination of a member’s account, all unused Reward Points, Tier Points, Tier Status, Rewards, benefits, and unredeemed promotional privileges associated with the account may be cancelled and forfeited, subject to applicable law.
A terminated or suspended member will not be entitled to compensation for forfeited Program benefits.
14. Death, Incapacity, or Account Closure
Reward Points, Tier Points, Tier Status, Rewards, offers, and Program benefits are personal to the member and, unless otherwise required by applicable law, do not pass to the member’s estate, heirs, beneficiaries, or other persons upon death.
If a member voluntarily closes their Program account, unused Reward Points and other Program benefits may be forfeited.
The Company may establish procedures for handling accounts of deceased or legally incapacitated members.
15. Taxes
Members are solely responsible for all federal, state, local, foreign, or other taxes, fees, reporting obligations, or other liabilities arising from the receipt or use of Rewards, benefits, promotional prizes, casino winnings, or other Program-related items.
The Company may require members to provide tax information or complete applicable tax documentation before issuing certain Rewards, prizes, winnings, or benefits.
16. Privacy and Communications
Participation in the Program requires the collection, use, and processing of certain personal information and gaming activity information in accordance with the Margaritaville at Sea Privacy Policy and applicable law.
Members are responsible for keeping their contact information accurate and current.
Members may receive communications regarding the Program, including account information, benefits, offers, promotions, and other Program-related information, subject to applicable law and the Member’s communication preferences. Members may opt out of promotional communications at any time using the unsubscribe or other opt-out methods provided in such communications. Opting out of promotional communications will not affect a Member’s participation in the Program or prevent Margaritaville at Sea from sending administrative or transactional communications related to the Program.

17. Program Modification
The Company reserves the right, subject to applicable law, to modify, suspend, restrict, replace, or terminate the Program or any aspect of the Program at any time.
This includes, without limitation, changes to:
- - The manner in which Reward Points or Tier Points are earned;
- - Earning or redemption rates;
- - Tier qualification requirements;
- - Tier levels;
- - Tier benefits;
- - Point expiration;
- - Rewards;
- - Promotional offers;
- - Participating ships, venues, or gaming activities;
- - Program partners;
- - Program technology;
- - Program rules; and
- - Any other Program feature.
Changes may affect Reward Points, Tier Points, Tier Status, Rewards, offers, or benefits previously earned or accumulated, subject to applicable law.
Where required by law, the Company will provide notice of material Program changes.
Continued participation in the Program after the effective date of revised Terms constitutes acceptance of the revised Terms.
18. Termination of the Program
The Company reserves the right to terminate the Program, in whole or in part, subject to applicable law.
Upon termination of the Program, Reward Points, Tier Points, Tier Status, Rewards, promotional offers, and other Program benefits may expire or be forfeited on the date designated by the Company.
The Company may establish a limited redemption period following announcement of Program termination but is not required to do so except where required by applicable law.
19. Limitation of Liability
To the fullest extent permitted by applicable law, the Company, its parents, affiliates, subsidiaries, officers, directors, employees, representatives, contractors, vendors, and agents (collectively, the “Released Parties”) will not be liable for any loss, damage, claim, cost, or injury arising out of or relating to participation in the Program or the acceptance, possession, use, misuse, loss, or redemption of a Reward or Program benefit, except to the extent such limitation is prohibited by applicable law.
To the fullest extent permitted by applicable law, the Released Parties will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from participation in the Program.
The Released Parties will not be responsible for delays, interruptions, cancellations, failures, or inability to perform resulting from events beyond the Company’s reasonable control, including, without limitation, acts of God, severe weather, hurricanes, natural disasters, fire, flood, war, terrorism, governmental actions, port closures, labor disputes, communications failures, system outages, equipment failures, vessel operational requirements, medical emergencies, or acts or omissions of third parties.
Nothing in these Terms is intended to waive or limit any right or liability that may not lawfully be waived or limited.
This section will survive termination of a member’s participation in the Program and termination of the Program.
20. No Guarantee of Program Availability
The Company does not guarantee that the Program, any casino-management system, player-tracking system, Rewards Card, benefit, Reward, promotion, gaming device, venue, or Program feature will be available at all times or on every vessel or sailing.
Temporary outages, system maintenance, equipment failures, operational restrictions, itinerary changes, or other circumstances may affect Program availability.
The Company may use reasonable alternative methods to record or administer eligible Program activity when available but is not required to provide retroactive credit for unverified activity.
21. Severability
If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
22. No Waiver
Failure by the Company to enforce any provision of these Terms on any occasion will not constitute a waiver of that provision or the Company’s right to enforce that provision in the future.
23. Governing Law and Dispute Resolution
Participation in the Program and these Terms will be subject to the governing law, venue, dispute-resolution provisions, maritime provisions, and other applicable legal terms established by the Company.
Any applicable dispute-resolution, arbitration, venue, class-action waiver, or governing-law provisions should be reviewed and approved by the Company’s legal counsel before publication of these Terms.
24. Entire Program Terms
These Terms, together with applicable Program rules, earning schedules, promotional terms, offer terms, privacy policies, casino rules, and other terms expressly incorporated by reference, constitute the applicable rules governing participation in the Program.
In the event of an inconsistency between these Terms and specific terms applicable to a Reward, promotion, event, or offer, the specific terms will control solely with respect to that Reward, promotion, event, or offer.
25. Contact and Program Information
Current information regarding Reward Point earning, Tier qualification, Tier benefits, point redemption, and other Program features may be obtained from participating Margaritaville at Sea casino locations, authorized casino personnel, or other official channels designated by the Company.
Members are responsible for reviewing the current Program rules and applicable promotional terms before participating in or redeeming any Program Reward, benefit, or offer.
